I will try to explain this in a layman language so that readers of this article can understand what life insurance is all about. Let me ask you a question before I continue. Of course, such death may result to loss of income to your family or dependants, inability to pay off mortgage loans, inability to finance children’s school fees, inability to maintain the current standard of living and family unable to handle certain events after death etc.
You will agree with me that the thought of the above alone can make person become anxious. This can even lead to sudden rise in blood pressure. The fear of what tomorrow may bring can rub one of today’s joy and peace. On the other hand, people may feel a sense of irresponsibility if they don’t think about the issues mentioned above. While it may seem good to think about them, such thought without taking steps to address the situation can lead to untimely death. If you find yourself in this type of situation, life insurance may be the solution to the problem. So, let’s go back to our question; “What is life insurance?” It is the type of insurance that protects your family, dependant or named beneficiary against the loss which might arise as a result of the death of the insured. In other words, life insurance will help your dependants to live the kind of life you would like them to live if you are alive so that they will not need to feel any financial loss that may arise as a result of your death. Apart from insurance against death, you can actually insure yourself against terminal illness, critical illness, disability due to ill health, permanent disability, or requirement for long term care. This includes death arising from war or by engaging in certain high risk activities such as skying or acrobatic flying.

Some people may say that that they are still young and they will eventually get it later. This is procrastination. Whatever you know it is right to do, just do it straightway. If you die today and there is somebody you think might suffer a loss and you don’t want such person to suffer the loss, you definitely need a policy to protect the person. I understand that everybody have financial commitments, It is good to make life insurance as part of that commitment. Of course, people buy life insurance for different reasons. For some, they may want to protect their spouse, children and other dependants. Others may want to stay committed to their good works after they must have passed on by continuing with their donations to the charitable organisation of their choice.

Now that you have realised you need to insure yourself, another question you may want to ask is, when is the right time to buy a policy? There is this general misconception about life insurance. Some believe that they need to wait till the time they are old or until they get married before they start thinking about life insurance. If you wait, you are actually putting the welfare of your dependants at a risk. Life is full of uncertainties. You cannot predict accurately when exactly you are going to die. When you read Newspapers or listen to news about obituary announcements, you will realise that death does not have respect for age. In fact, the earlier you buy life insurance the better. A single may not have as much responsibility as a married person. Although there may be some exceptions to this. But the truth is that, your responsibility tends to increase when you become married. - Debts: A person having a huge outstanding mortgage loan balance to pay will be required to take higher life insurance than someone with little or no mortgage balance to pay. If you leave huge mortgage loan balance behind for your family without any insurance to cover the payments, you may be exposing your family to the risk of foreclosure.

I suggest that you open a file for your policy where you can file both the policy and the receipts of the premium paid. It is also important that you let your beneficiaries or someone you trust to know where you keep the file. Understanding Irrevocable Life Insurance Trust (ILIT)
Now that you understand what the life insurance is and why you need it, let’s us take it a little step further. Having said that your life insurance is part of your estate planning, you need to be sure that the planning is done strategically. Otherwise, you may be creating problems for the beneficiaries of the policy in one way or the other. I will explain this so that you can understand it very well. At death, your life insurance becomes part of your estate and could be subject to tax if the value of your estate exceeds the estate tax threshold. If the value of your life insurance policy is quite high, your beneficiary may find it difficult paying the estate tax. Secondly, if your beneficiary is not disciplined financially, receiving a large amount as lump sum payment being the proceeds from your life insurance policy may encourage him to spend the whole money carelessly. Thirdly, it is possible to lose the entire insured amount to litigation if the beneficiaries have lawsuits against them. This means losing all what you have laboured to achieve. Although you would no longer be alive to witness all these, the purpose of the life insurance would have been defeated. In order to guide against all these, you may choose to set up Irrevocable Life Insurance Trust (ILIT) to handle your life insurance.
What is Irrevocable Life Insurance Trust?
Irrevocable Life Insurance Trust (ILIT) operates just like any other trust. But in the case, the trust is set up for the purpose of holding your life insurance policies. However you need to understand that once the Life Insurance Trust has been established and funded, it is irrevocable. Nevertheless, in order to keep the ILIT running, you will need to be paying your premium through your trustee in form of tax free gifts. Through the trust document, you will need to appoint a trustee to manage the trust. You will also name the beneficiaries and state the ways and manners you will want the beneficiaries to receive money from the ILIT. Thereafter, you will not have any right to change or terminate the trust. Can you change the beneficiary of an irrevocable life insurance trust? The answer is ‘No’. That is why it is called irrevocable. The implication of this is that you will lose the ownership to the ILIT. That is, you will no longer be considered as the owner of the policy thereby making IRS not to consider the insured amount as part of your estate. With this, the insured amount will be exempted when calculating your estate taxes. But there is an exemption to this. If you transferred your life insurance policy to Irrevocable Life Insurance Trust (ILIT) within three years before your death, the proceeds from the policy will still be included as part of your taxable estate when calculating the estate tax payable by the IRS.
For people who are concerned about the likelihood of creditors taking over their estates, Irrevocable Life Insurance Trust (ILIT) can be a good way of preventing creditors from accessing your life insurance policy. It can also be used to protect beneficiaries who are recipients of government benefits like Medicare from losing the benefits. If you are on traditional life insurance policy where proceeds are paid directly to the beneficiaries, this can make them to forfeit the government benefits they enjoy. With the Irrevocable Life Insurance Trust (ILIT) document, you can manage the way the proceeds of the life insurance policy will be disbursed so that the beneficiary may not have outright ownership to the policy.
